Terms of Service
At a glance
- Be kind and lawful. Don’t misuse Capsule or harm others.
- You own your content. You grant us a limited license to operate the service.
- End-to-end encryption has tradeoffs. If you lose your keys/devices, we may not be able to recover encrypted content for you.
Agreement to these terms
These Terms of Service (“Terms”) govern your access to and use of Capsule’s applications, websites, and related services (collectively, the “Services”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility
You must be at least 13 years old to use the Services (or the minimum age required in your country). If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
Accounts and authentication
You are responsible for your account and for maintaining the confidentiality of any access methods you use (for example, email-based one-time codes). You agree to provide accurate information and to promptly update it if it changes.
You agree not to access or attempt to access another user’s account without permission, and you agree to notify us promptly if you believe your account has been compromised.
Privacy
Our Privacy Policy explains how we collect, use, and share information. By using the Services, you agree that we can process information as described in the Privacy Policy.
Encrypted content and key management
Capsule is designed with end-to-end encryption for certain content. This means your Capsule entries (like thoughts, songs, responses, and encrypted photos) may be encrypted on your device before being stored or transmitted.
Important: Because end-to-end encryption is designed so that we cannot access certain content, we may not be able to:
- recover encrypted content if you lose your device, keys, or secure storage,
- restore access if your keys are deleted or corrupted, or
- assist with decrypting content beyond what the app can do with your keys.
You are responsible for managing your devices and any device-linking features you enable, including keeping them secure.
Your content
Ownership
You retain ownership of the content you create, upload, or store through the Services (“User Content”).
License to operate the Services
You grant Capsule a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, and display your User Content solely to operate, provide, and improve the Services (for example, syncing your content, delivering it to recipients you choose, and generating backups).
Sharing with others
When you share content with friends or recipients in Capsule, those recipients may be able to view, copy, or save that content. You are responsible for what you share and with whom you share it.
Acceptable use
You agree not to misuse the Services. For example, you will not:
- use the Services for unlawful, harmful, or abusive purposes,
- harass, threaten, impersonate, or defraud others,
- attempt to bypass security, rate limits, or access controls,
- reverse engineer or attempt to extract source code except where permitted by law,
- interfere with or disrupt the Services (including by introducing malware),
- send spam or unsolicited invitations at scale, or
- infringe intellectual property or privacy rights of others.
Third-party services
The Services may rely on third-party providers (for example, hosting, authentication, storage, push notification delivery, and content management). Your use of third-party services may be subject to their own terms and policies. We are not responsible for third-party services outside our control.
Termination
You may stop using the Services at any time. You can delete your account and all associated data at any time from within the app (Settings → Account → Delete account). We may suspend or terminate your access to the Services if we reasonably believe you violated these Terms, if required by law, or to protect the Services or other users.
Termination may result in loss of access to your account and content. Due to encryption and system design, content recovery may not be possible after deletion or termination.
Disclaimers
The Services are provided “as is” and “as available”. To the fullest extent permitted by law, Capsule disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Services will be uninterrupted, error-free, or fully secure. You understand that use of the Services is at your own risk.
Limitation of liability
To the fullest extent permitted by law, Capsule will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, resulting from or related to your use of (or inability to use) the Services.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
Changes to these terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to provide notice (for example, by posting the updated Terms on this page). Your continued use of the Services after the effective date of the updated Terms constitutes acceptance.
